尽管存在商标侵权,但我无法将卖家从我的商品页面中移除

I'm a brand owner, and a foreign seller is listing my product using FBM. I suspect they're not actually selling, but I don't want them listed. My product is in the cosmetics category, but my trademark registration isn't, so I'm not sure if an exact match is necessary. Additionally, my brand name doesn't appear in the product title, bullet points, or anywhere else. Is this a problem? I've attached a screenshot showing Amazon's reasoning for rejecting my request to remove this seller. I'd appreciate any advice.​
 
Based on the comments mentioned here, I would like to add the following: I have already placed a test order, and the infringement complaint that was rejected was in fact the one I filed together with the test order evidence. Therefore, I need different alternatives and approaches to resolve this issue.

如果侵权者售卖的站点和你持有商标的站点是一致的,那么即使你注册的商标分类不一致,那么也是可以投诉的。在亚马逊上,他们更看重的是品牌名是否一致,商标分类不一致一般不影响投诉成功率。

如果你说的是不同站点的侵权者。那么原则上不能投诉的,商标保护也是具备区域性的,所以才会衍生产品要注册各个站点的商标。

但是实际情况中,有些卖家不懂商标法 ,而且审核人员也不仔细研究商标所属站点,从而就造成商标侵权,但是这种概率是比较低的。正常情况是抢注某个站点的其它类目商标,或者抢注我们在售链接但是无商标的站点,这两种投诉,或者恶意商标勒索的会很多(抢注域名也是类似道理)

如果你某个站点未来有销售的计划,建议也提前布局商标,避免被人恶意抢注投诉勒索。

你注意看你在投诉对方侵权的时候,有没有选错选项。例如产品上的商标侵权,选错成Listing上面的侵权了。可以找客服一并排查下。
